This privacy notice/policy applies to Jason Hunter conducting the business of the provision of his services as a civil mediator or as an executive coach

In this notice “I” or “me” refers to Jason Hunter and “you” refers to any individual whose personal data is held or processed by me.

I provide services as a civil mediator or as an executive coach (in each case, on a self-employed basis) and accordingly I am an independent controller of personal data under applicable data protection law. 

I take the privacy of your information very seriously. This privacy notice is designed to tell you about my practices regarding the collection, use and disclosure of personal information which may be collected in person from you, obtained via my website or collected through other means such as by an online form, email or telephone communication. When I do so, I am subject to the UK General Data Protection Regulation (“UK GDPR”) and Data Protection Act 2018. I may also be subject to the EU General Data Protection Regulation (“EU GDPR”) in relation to services that I offer to individuals in the European Economic Area (“EEA”). 

This notice applies to personal information provided to and processed by me, and relating to the following:

  • clients (actual or prospective)
  • other parties to mediation cases involving my clients
  • professionals who instruct me in relation to my mediation services
  • professionals to whom I provide executive coaching services
  • website users
  • suppliers

How I get the personal information and why I have it

Most of the personal information I process is provided to me directly (including by email, telephone or a site such as LinkedIn) by you for one of the following reasons:

  • To respond to enquiries about my services
  • To appoint me to provide my services
  • To enable me to manage the provision of my services including, for example, invoicing

If applicable I might also receive personal information indirectly, from the following sources in the following scenarios:

  • Your representatives via whom I might be or am appointed to provide my services
  • Via my website www.jasonhunterconsultancy.co.uk – I may in due course collect information about how my website is used – see the section at the end of this policy. I use a third-party data processor [name] to host my website and help maintain its security and performance. To deliver this service it processes the IP addresses of visitors to my website.

I use the information that you have given me for the reasons set out above, i.e. to potentially provide, or to provide, my services. 

Under the UK GDPR, the lawful bases I rely on for processing this information are: 

(a) If you have consented to the processing of your personal information, then I may process your information for the purposes set out above to the extent to which you have consented to me doing so. You are able to remove your consent at any time. You can do this by contacting me, on the details set out above.

(b) If processing is necessary for the performance of a contract for my services or in order to take steps at your request prior to entering into such a contract.  I have a contractual obligation.

(c) In certain circumstances processing may be necessary for me to comply with a legal obligation to which I am subject. 

Who will I share your personal information with?

It may be necessary to share your information with the following:

  • Data processors, including those mentioned above, and others such as data storage providers
  • Regulatory authorities, such as the Information Commissioner’s Office. In this case, there is a risk that for information may lawfully be disclosed by them for the purposes of any other civil or criminal proceedings, without my consent or yours.

I may be also required to disclose your information to the police or intelligence services, where required or permitted by law. 

Transfer of your information outside of the UK or EEA

I do not transfer the information you give me to countries outside the EEA, except where the international transfer is necessary in connection with the services I am providing to you.

If you are outside the EEA, your information may be transferred outside the EEA in order to provide you with my services. By submitting your personal information to me in this way you agree to the transfer and processing of your information outside the EEA. 

Data retention

The table below sets out the default retention periods for storing your personal information:

Please note that the above table sets out the default retention periods, and there may be circumstances in which the records are kept for a shorter or longer period, for as long as legitimately necessary to enable me to perform my services or for as long as required by law or any regulatory obligations which may apply to me.

Security

I will take all reasonable steps to ensure that appropriate technical and organisational measures are carried out in order to safeguard the information I collect form you and protect against unlawful access and accidental loss or damage. 

For example, your electronic information will be stored on my devices which are password protected. I run anti-virus software on my laptop (which I use to process personal data as envisaged in this privacy notice).

However, please note that the transmission of information via the internet is never completely secure. Although I will do my best to protect your personal data, I cannot guarantee the security of your electronic information transmitted to me and any transmission is at your own risk.

Your data protection rights

Under data protection law, you have rights including:

Your right of access - You have the right to ask us for copies of your personal information. 

Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. 

Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances. 

Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances. 

Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.

Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

This privacy notice was published on the date stated at the beginning of it. 

I will continually review my privacy practices from time to time, which may require me to change this notice from time to time.

As at April 2024 it is not my intention that my website use cookies. If in due course, it does, this section will apply.
